Sports Arbitration Steps
Learn about the six essential steps of the sports arbitration process in Morocco
Filing an Arbitration Request
The party wishing to resort to arbitration must submit a written request that includes, under penalty of inadmissibility: the full name and address of the claimant, the name of their legal representative (when applicable), a brief presentation of the facts and legal arguments and issues presented, a copy of the arbitration agreement or evidence of resorting to it.
Filing an Appeal Declaration
The appeal declaration includes the following elements: the name and address of the respondent, a copy of the contested decision, a presentation of the respondent's defenses and requests, a copy of the provisions of the basic statute or arbitration agreement, a justified request for suspension of execution (when applicable).
Payment of Prescribed Fees
Based on Decree No. 2.10.628 issued on 7 Dhul Hijjah 1432 (November 4, 2011) implementing Law No. 30.09 relating to physical education and sports, particularly Articles 74 and 77 thereof. In application of the provisions of Article 74 of Decree No. 2.10.628 referred to above, the registry fee is set at 1000 dirhams. In application of the provisions of Article 77 of the aforementioned Decree No. 2.10.628, the administrative costs of the Sports Arbitration Chamber are calculated according to the specified table.
Determining the Final Amount of Fees
Upon completion of the proceedings, the registry determines the final amount of arbitration fees, which includes: registry fee, administrative costs specific to the chamber, arbitrators' fees according to a table determined by the Minister in charge of sports, contributions to chamber expenses, costs of witnesses, experts, and translators. This amount is included in the operative part of the award or communicated to the parties separately.
Notification of Parties
The chamber's registry handles notification and service procedures, which are carried out by registered mail with acknowledgment of receipt, and are sent to the addresses provided in the arbitration request or appeal declaration, or to any address subsequently specified. Note: In case of non-compliance with conditions, a specific deadline is granted to remedy the deficiency, otherwise the declaration is considered as if it never existed.
Arbitral Award
The arbitral tribunal issues its award by majority vote, and the award must be written, reasoned, dated, and signed by all arbitrators and the registry. The award is communicated to the parties within eight (8) days from the date of its issuance. The first instance award is subject to appeal within ten (10) days from the date of notification. The final award, whether first instance after the expiry of the appeal period or appellate, becomes enforceable and not subject to any appeal.
